1. Acceptance of Terms

By making a reservation, completing a payment, or participating in any activity organized by Diving Planet S.A.S., you acknowledge that you have read, understood, and accepted these Terms and Conditions, our Cancellation Policy, and our Privacy Policy.

2. Reservations and Payments

Reservations are confirmed upon payment of the required deposit indicated during the booking process.

Unless otherwise specified, the reservation deposit corresponds to 30% of the total activity price. The remaining balance must be paid upon arrival on the day of the activity, before its commencement.

3. Voluntary Gratuity

As part of our commitment to regenerative tourism, we believe that a great experience should also create a positive impact on the people who make it possible. For this reason, during the booking process, we invite our guests to recognize the dedication of the team involved in delivering our services through a suggested voluntary gratuity, helping to strengthen the local economy.

The gratuity is entirely voluntary. Guests who choose not to leave a gratuity may request its exclusion before the activity or request a refund within thirty (30) calendar days after the activity has taken place, without this affecting the quality of the service they receive.

4. Cancellation Policy

a) Cancellation by Diving Planet

If Diving Planet cancels an activity due to adverse weather conditions, operational safety reasons, force majeure, or circumstances beyond our reasonable control, guests may choose between:

Rescheduling the activity (subject to availability), or
Receiving a full refund of all amounts paid.

Refunds will be processed through the original payment method and may require up to two weeks to appear, depending on the banking institution.

b) Cancellation by the Customer

Reservations may be cancelled under the following conditions:

Until 12:00 p.m. (noon) on the day before the scheduled activity: a refund of 95% of the amount paid will be issued. The remaining 5% covers payment processing and administrative fees.
After 12:00 p.m. (noon) on the day before the activity: no refund will be issued.

If the reservation includes PADI eLearning, the value of the digital course is non-refundable once the access code has been issued. The participant will retain access to the course and may complete the practical training at any PADI Dive Center within the validity period established by PADI.

c) No Refunds

No refunds will be granted in the following situations:

Cancellation after 12:00 p.m. (noon) on the day before the activity.
Failure to appear ("No Show").
Arrival after the scheduled departure time.
Voluntary interruption or abandonment of the activity after it has begun.
Failure to participate due to incomplete documentation, medical restrictions, failure to meet certification requirements, or failure to follow Diving Planet's operational or safety procedures.

5. Health and Safety

Participants are responsible for providing accurate information regarding their medical condition and diving qualifications.

Diving Planet reserves the right to deny participation to any individual whose medical condition, physical condition, certification level, or behavior may represent a risk to themselves or others.

All participants agree to comply with the instructions provided by Diving Planet's instructors, divemasters, captains, and staff. Failure to follow safety instructions may result in removal from the activity without refund.

6. Photography and Video Authorization

During our activities, Diving Planet staff may take photographs and videos for promotional, educational, documentary, or marketing purposes.

By making a reservation and participating in our activities, participants grant Diving Planet S.A.S. permission to use such photographs and videos, without compensation, on its website, social media platforms, printed materials, advertisements, and other promotional channels.

Participants who do not wish to appear in photographs or videos must notify Diving Planet in writing before the activity begins. Diving Planet will make reasonable efforts to respect this request whenever operationally possible.

7. Personal Data Processing

Diving Planet S.A.S. processes personal data in accordance with Colombian Law 1581 of 2012 and Decree 1377 of 2013.

Personal information is collected solely for purposes related to reservations, customer service, operational requirements, safety, marketing communications, and the provision of our services.

8. Intellectual Property

All content displayed on this website—including text, photographs, videos, graphics, logos, trademarks, and designs—is the exclusive property of Diving Planet S.A.S. or is used under appropriate authorization.

No content may be copied, reproduced, distributed, modified, or used without prior written authorization.

9. Modification of Terms

Diving Planet S.A.S. reserves the right to update or modify these Terms and Conditions at any time without prior notice.

The version published on this website at the time of booking shall govern the contractual relationship with the customer.

10. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Colombia.

Any dispute arising from these Terms shall be subject to the jurisdiction of the competent courts of Colombia.

11. Safety Standards

All diving, snorkeling, and water activities conducted by Diving Planet S.A.S. are carried out in accordance with applicable Colombian regulations, internationally recognized safety practices, and, where applicable, PADI Standards and Procedures.

The safety and well-being of our participants are our highest priority. Therefore, the decisions made by Diving Planet's instructors, divemasters, captains, or other authorized staff regarding a participant's fitness to participate, dive planning, environmental conditions, or the continuation, modification, or cancellation of any activity for safety reasons shall be final and binding, and shall not constitute grounds for compensation or refund.
